Buying, Selling, Titling and Loaning Problems



Welcome to my own Real Estate Problems blog.
I decided to put up this blog to assist
people gain knowledge on the intricacies
of the real estate business and transactions.

REMEMBER though, I am no expert. just want to
share what I know. Nevertheless, take note that
real estate problems are the areas of a Realtor,
and not of lawyers.

This is one of the most important things to consider.

    my employer (corp) will buy a property in negros, just asking how do i go about it, may checklist ka ba on transfer of title? may zonal valuation ba posted in the net, so i can estimate the capital gains tax., thanks in advance.

  5. hi banker,gs2 lng po ako malinawagan... 2 nlng magkapatid c tito j at tita m. ibig sabihin 50-50 cla s property n naiwan ng parents (both dead n) nla since wla nman last will. c tita m,wlang asawat anak. c tito j, may asawat anak. pag dead n c tita j, san po mpu2nta ung properties nya f wla xa last will?f merun xa last will, 100% b o ilang portion lng ang pwd nya dispose s khit knno o hnd kamag-anak? sana matulungan po ninyo ako. tenks

    need your help..

    this is my story..

    yung lola ko is my property na lupa and yung titulo is nakapangalan sa kanya..without our knowledge, kinuha yung titulo ng lupa ng brother ko at ginamit nya yun as collateral para makautang ng pera sa isang tao..ngayon, namatay na yung lola ko and yung taong pingakakautangan ng kuya ko is pilit na kinukuha na yung lupa kasi my brother is missing and hindi namin alam kung magpapakita pa sya o hind na.

    please advise if possible ba na makuha yung lupa ng lola ko? what are we going to do para mabawi yung titulo?

  7. He cannot get that property if your lola did not sign any document.

    kung gusto ninyo makuha:
    1. make a formal demand
    2. kung walang action, file sa court Petition to surrender the title, kung hinde, i-cancel yun and you will be issued a new one.

  8. Hi Banker, yung uncle ko nag offer na ako na lang daw mag assume nang bahay niya to an agreement that I will just pay him any amount I could afford every year until I could finish paying the amount for house assumed. We didn't have written agreement for that, verbal only that is.
    Now, He has an adopted daughter (legally), and I'm afraid kasi until now hindi pa na ta-transfer sa name ko yung name like the deed of sale, deed of assumption kasi nga hindi ko pa tapos bayaran yung amount. I am the one currently paying the monthly payment sa PAGIBIG and yun nga my name doesn't still appear on the receipts or any papers kaya wala akong laban if ever gusto kunin nang adopted child nya in the future yung bahay. Hindi ko pa talaga kayang buuin bayaran ang exact amount. But I'm paying paunti-unti and it is documented like having receipts for all the payments I made to my uncle and to PAGIBIG. Ano po bah magandang gawin jan Banker so I could be ready if ever his adopted daughter will get it? Help po :(

    Also an employer who's holding the account of our house in PAGBIG told me to process the deed of sale/assumption/power of atty very soon. Kaso 3rd assumee na ako, my uncle was the second and still ang naka indicate na name doon sa account nila is the ORIGINAL OWNER + My uncle's name. Sabi nung attendant I'll bring daw the "original owner" with our lawyer to sign all the papers? Would that mean it's okay if I could not pay my uncle and I could have the all documents in my name na po? By the way nasa akin na po actually yung mga original deed of sale in my uncles name binigay niya sa akin. Kasi baka daw may ibang kumuha non if he'll bring it to the province.

    Another thing is I haven't paid to PAIGBIG for about 1 year na po :( But I'm trying na habulin yung payment po.

    Please advise me what to do. Ayoko pong makuha yung house. Super hirap mag rent sa panahon ngayon.

  9. there is only one problem:
    WALA KAYONG LEGAL DOCUMENT

    everything you do is therefore
    "illegal"

    even brothers have formal documents to support
    any transactions.
